Rabbi Lawyer’s Article Published in Daily Journal

I’m pleased to share that my article was recently published in the Daily Journal.

The Daily Journal is the largest legal newspaper in the country, circulated in the metropolitan areas of both Los Angeles and San Francisco.

My article discussed the recent case of Greener v. M Phelps, Inc. The Court of Appeal in this case affirmed the jury verdict of $46 million awarded to a jiu jitsu student who was paralyzed while sparring with his instructor.

My article discusses the “assumption of the risk” doctrine under California law. It might sound scary, but I explained this concept more fully in a blog post last year.

Personal injury cases involving sporting activities often fail because of the “assumption of the risk” rules. Nevertheless, in this particular case, the experienced jiu jitsu instructor was found liable becuase he unreasonably increased the risks when he sparred with a novice student.
